Re: [LUG] Sales???

Your statutory rights can not be affected by sales, etc. SOGA still applies. Anything bought retail has to be fit for the purpose intended. (Unless it's being sold as faulty and the faults are clearly identified)

And remember - it's who you bought it from, and not the manufacturer who is liable for refunds, repairs, replacements, etc. Do not let them fob you off with any other story.

Knowing it in theory and the practicality of standing your ground in a shop where the staff stubbornly ignore your rights and refuse point-blank to co-operate are two different things. A friend of mine bought a mobile phone from a well-known phone shop. Didn't work, took it back. Their absolute refusal to have anything to do with it got to the point of him almost being thrown out as he stuck to his guns. Trading Standards won't touch anything with less than thousands of complaints - in writing corroborated - so where does that leave the consumer? You *can* write to Trading Standards but unless thousands of others have as well you'll be out of luck. Writing to the company's Head Office with a copy to your MP (also in Wales Assembly Member) is my favoured tactic and it usually bears fruit as company CEOs don't like seeing 'cc XXX XXXX, MP' at the foot of letters.
