[LUG] How to test for throttling and what should I look for?

Hey guys,

Back to this age old subject of how rubbish our internet service is. Currently the maximum speed that I can download at via torrents is around 4.86MBps, I run speed tests which say I should be able to reach speeds of 48Mbps, My ISP provides upto 76Mbps

Here is some gumpf I got from an M-Lab test

The theoretical network limit is 35.09 Mbps
The NDT server has a 403.0 KByte buffer which limits the throughput to 180.89 Mbps
Your PC/Workstation has a 721.0 KByte buffer which limits the throughput to 161.57 Mbps
The network based flow control limits the throughput to 67.78 Mbps Client Data reports link is 'T3', Client Acks report link is 'T3' Server Data reports link is 'T3', Server Acks report link is 'FastE'

My ISP offer two packages, upto 78Mbps or upto 38Mbps, Seeing as the theoretical limit is 35Mbps am I paying too much for the service which it would seem they can not provide?

Could somebody explain this to me please?

Kind Regards
