Just as the "no reverse engineering" clause is unenforceable under European law (which bizarrely the clause in the XP EULA mentions if only indirectly). Most of the effect of such clauses is to scare people into doing what the author of the agreement wants, there is no way it could be enforced. Unless you are a party to the contract, and concerned that the clause might be enforceable, there really isn't a lot we can do to stop lawyers trying to control folks with scary legalese.
