Is it worth pushing this anywhere, or seeking legal advice (i can't
afford it or i would), either they are duty bound to give you your
money back and if someone refuses they they have violated the EULA or
the EULA isn't worth the paper/disk space/band with it consumes and we
can all ignore it!

I suspect however that even if the EULA is valid its up to MS to in
force it and they will just say "so what" / "screw you" as its not in
there interest to upset the OEMs who push there products for them.
