Yes, if your erp goes too high, you need a license. I can't remember what the 
legal limit is nowadays - I think it's 250mW.
erp is measured at the output from the Ae.
Ireasing the amplification often only affects transmit power.
Increasing the db gain of the Ae increases transmit and receive.
So it's often better to lower the transmit power and use a better Ae in order 
to stay within the legal limits.
