The Federation Against Software Theft (FAST) and Microsoft would take 
issue with that view, not to mention the legal system of the UK.

While logically accurate it is legally untenable.  It ignores 
Intellectual Property.  Any commercial software house licenses you to 
use their software *for a fee*.  Depending on the license, you pay them 
a fee in order to install and run their software on X number of 
machines.  Using it without paying them the required license fee [1] 
is.. what exactly?
