Software has always been protected by copyright, and I see no signs that

Indeed I think the balance is still wrong because it is a publishing
model. Effectively paying people sit on their laurels in software.

I think both proprietary and free software will head towards
subscription like models, although we still need to develop good working
models for this in the free software world.  Which is how it should be,
paying people for services and time, not for near zero cost automated
reproduction of numbers.
