Government to second guess its decisions. "

Erm - no - but the government should give the ICO direction.

It seems the ICO asked Phorm - phorm's response to the ICO was widely
regarded as economical with the actuality.

Also the ICO response doesn't cover that data was released by BT without
consent. One of the problems is the ICO has to rely so heavily on what
companies say.

The phorm system clearly falls foul of the Interception of
Communications act, and if your ISP tries to adjust there terms and
conditions one can of course refuse, and if they insist, one is freed
from contractual obligations (i.e. minimum contract length). Just take
your business somewhere else.
